Court quashes the Council’s decision to merge a village school with a primary school

The court quashed the defendant Borough Council’s decision to merge a village school with a nearby primary school. The Court stated it had failed to comply with the applicable requirements of the statutory decision-making process. HHJ Keyser stated that “Taken together, those failures can, in my view, be seen to be both a cause of an inadequate approach to the decision-making process and symptomatic of a failure to engage with the ethos of the statutory provisions”.
