The Court of Appeal has handed down a non-anonymised judgment (and lifted reported restrictions) in the case of Khan v Meadows EWCA Civ 152, a “wrongful birth” clinical negligence case. Unusually, in November 2018 the Court handed down an anonymised version of the judgment, and imposed restrictions on reporting the identity of the claimant or her child, despite the judgment at first instance not having been anonymised and notwithstanding the fact that both the trial and the hearing before the Court of Appeal took place in open court without any restrictions on open justice. Following an application by the Press Association, the anonymity order was lifted by consent.
