Court considers rights of offenders following license breaches

Re: R (Youngsam) v The Parole Board [2017] EWHC 729 (Admin)

The claimant contended, inter alia, that the delays that occurred before the matter of further release was considered by the Parole Board breached his ECHR, art 5 and common law rights.  The scope of doctrine and precedent was considered, and particularly the determination of what part of a court can properly be considered the ratio decidendi. The Court refused permission for judicial review and found that the claimant’s case failed.
