Court of Appeal grants injunction preventing defendant newspaper from publishing an account of the applicant’s extramarital sexual activities

Re: PJS v News Group Newspapers [2016] EWCA Civ 100

The applicant was in the entertainment business. He challenged the decision to refuse an injunction preventing the respondent newspaper from publishing an account of his extramarital sexual activities. He argued that the judge had erred in balancing the competing rights at play. Held: The applicant’s ECHR, art 8 rights prevailed over the defendant’s art 10 right to publish the account. Hugh Tomlinson QC, Lorna Skinner, Gavin Millar QC and Ben Silverstone were involved in this case.
