Court agrees additional 10% interest on unlawful detention award

The claimant was unlawfully detained by the Home Office for a total of 445 days, and awarded damages of £78,500 at an interest rate of 2%. This case was an application for an enhanced interest rate pursuant to the Civil Procedure Rules 1998, r 36.17(4).
The Court accepted this argument and awarded an additional amount of 10% to the award of damages and interest. Significantly, the judge awarded 6% over base interest on both damages and costs.
