Conditions in Italy for asylum seekers considered

Two appeals brought by individuals seeking asylum who arrived in the UK via Italy. The question for the Court was whether to return them to Italy under the Dublin Regime without considering their claims. The appellants contended that the conditions for asylum seekers and BIPs were so inadequate that this would risk a breach of the ECHR, art 3. The appeal was dismissed.
