The Court dismissed the appeal by a majority of 4:1 concerning the respondents’ decision to refuse an inquiry into the killing of 24 unarmed civilians by Scots Guards in Batang Kali in 1948. The Justices dismissed the appeal under the ECHR, art 2, because there was not a “genuine connection” between the death and the critical date. Lord Neuberger also stated that they had given coherent reasons for not holding an inquiry.
