The appeal concerned the decision by the BBC to cap the part of a pay rise at 1% that would be used to calculate pensionable pay in the final salary sections of the BBC Pension Scheme. The appeal was dismissed. The Court held, inter alia, that it was open to the BBC to determine how much of the pay rise would count as Basic Salary and thus how much was pensionable.
