Re: Yeo v Times Newspapers Ltd [2015] EWHC 3375 (QB)

The claimants challenged the Housing Benefit Regulations 2006, Part 8A, which provided for a benefit cap on those in receipt of carer’s allowance. The court held that the application of the benefit cap to those who provided full time and unpaid care to the severely disabled was unlawful, as it discriminated against those with disabilities who were cared for by family members. This impact had not been considered by the defendant and it was not justified.
