Claims regarding the exercise of police powers have always been a core element of Matrix’s practice. They engage our practitioner expertise across a very wide range of disciplines including civil litigation, crime and public law and are at the heart of many human rights challenges.

Our interest in this field is long-standing. Hugh Tomlinson QC is co-author of the seminal work “Civil Actions Against the Police”, first published in 1986 and widely accepted as the leading text in this area. It is currently going into its fourth edition. Several other practitioners have written and lectured extensively on police powers.

Matrix counsel, both leading and junior, have been involved in many of the most important cases in recent years. Our unique depth and range in this area is recognised by all the directories in which most of our practitioners are ranked, many in the first tier.

The team also has extensive expertise in claims for compensation for miscarriages of justice, under both the current and former schemes.

We cover the full range of work from small claims in the County Court to complex claims in the European Court of Human Rights. This includes:

• Damages claims for malicious prosecution, false imprisonment, assault, negligence, misfeasance in public office.

• Challenges to policing decisions in all arenas, including the Administrative Court by way of judicial review, the Investigatory Powers Tribunal, and the European Court of Human Rights.

• Claims under Articles 2, 3, 5, 8 and 14 of the European Convention on Human Rights.

• Discrimination claims, including claims against the police in the civil courts and claims by police officers in employment tribunals.

• The use of police powers in the context of anti-terrorist policing.

• The interplay with other areas of law such as immigration, defamation, mental health, prison law, inquests, and employment law.
