The law of data protection is based around and informed by areas of law that represent core strengths of Matrix - human rights law, media and information law, and freedom of information.
Members of Matrix data protection team advise a wide range of organisations including public authorities, companies and private individuals on their responsibilities and rights.
In December 2004 Matrix launched a Freedom of Information group in anticipation of issues that will be raised after the Freddom of Information Act (FOIA) came into force at the start of 2005.
The Act itself is a complex piece of legislation and includes more than 20 exemptions of a variety of different types. Applicants for information will seek to challenge the application of exemptions by public authorities. In particular, detailed guidance is likely to be required as to the application of the “public interest test” in relation to “qualified exemptions”. A further range of problems will arise in the area of “reverse freedom of information” – challenges by “owners” of information held by public authorities who are seeking to prevent its disclosure under FOIA provisions. |
